Acceptable Use Policy

Version 1.0 Effective 7 July 2026

This Acceptable Use Policy ("AUP") is incorporated into the APEX Pando Terms and Conditions and applies to all use of the Service. EXOR may update this AUP from time to time to address new or emerging misuse; the current version is available at /legal/acceptable-use. Capitalised terms have the meanings given in the Terms.

Breach of this AUP is a breach of the Terms and may result in suspension or termination under clause 6 (Resource Abuse and Termination for Cause) and clause 16.5 (Suspension for legal or security risk).


1. Purpose

This AUP sets out what you may not do when using the Service. It exists to keep the Service secure, lawful, reliable, and fair for all Tenants on shared infrastructure.


2. Prohibited content

You must not upload, display, or distribute through the Service any content that:

2.1. Is unlawful, or promotes unlawful activity. 2.2. Infringes any third party's intellectual property, including copyright, trademark, or image rights. You are solely responsible for holding all necessary rights and licences for content you display (see Terms clause 14). 2.3. Is defamatory, obscene, pornographic, or sexually explicit. 2.4. Depicts, promotes, or facilitates violence, terrorism, self-harm, or harm to others. 2.5. Constitutes hate speech or harassment, or discriminates against or vilifies any person or group. 2.6. Sexualises, endangers, or is otherwise harmful to minors. (Zero tolerance — see clause 6.) 2.7. Is fraudulent, deceptive, or constitutes a scam or phishing. 2.8. Discloses personal data of others without a lawful basis, or breaches privacy or data-protection law. 2.9. Contains malware, or is designed to disrupt, damage, or gain unauthorised access to any system.


3. Prohibited conduct

You must not:

3.1. Use the Service to breach any applicable law or regulation. 3.2. Attempt to circumvent, disable, or interfere with Plan limits, allocations, licensing, security controls, or tenant-isolation mechanisms. 3.3. Gain or attempt to gain unauthorised access to the Service, other Tenants' data, or any connected system or device. 3.4. Probe, scan, or test the vulnerability of the Service, or breach its security or authentication, without EXOR's prior written consent. 3.5. Interfere with or disrupt the Service, servers, or networks, including through denial-of-service activity or excessive load. 3.6. Reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law. 3.7. Resell, sublicense, or provide the Service to third parties except as expressly permitted (for example under an agreed white-label arrangement). 3.8. Use the Service to build or assist a competing product, or to benchmark it, without consent (see Terms clause 16.8). 3.9. Impersonate any person or entity, or misrepresent your affiliation. 3.10. Use automated means or the API (Enterprise only) to circumvent limits, overload the Service, or scrape data beyond your own.


4. Resource and fair use

4.1. The Service runs on shared infrastructure. You must use resources (compute, bandwidth, storage, connections) fairly and reasonably. 4.2. You must not consume resources in a manner that is excessive, abnormal, or that degrades the Service for other Tenants. 4.3. You must upload optimised media in line with our guidance. Uploading unnecessarily large, unoptimised, or excessive files that waste storage or bandwidth is prohibited. (The Service may reject or resize non-compliant uploads and enforces storage limits at upload.) 4.4. You must not use storage as a general-purpose file store unrelated to operating your displays. 4.5. You must maintain your media library, removing unused content. Hoarding of unused media may be treated as resource abuse.


5. Devices, security, and integrations

5.1. You are responsible for securing your player/agent devices, displays, network connections, credentials, and any connected hardware (including IoT/sensor devices). 5.2. You must follow proper security protocols and our published guidance to keep the Service and your environment safe (see Terms clause 5.2). 5.3. You must not connect compromised, insecure, or unauthorised devices that could put the Service or other Tenants at risk. 5.4. You must not route personal data through Sensor Data channels (see Terms clause 8.4). 5.5. You must comply with the terms of any third-party service you integrate (for example POS, payment, or messaging providers).


6. Zero-tolerance matters

The following result in immediate suspension or termination without notice and without refund, and may be reported to the competent authorities:

6.1. Content that sexualises, exploits, or endangers minors. 6.2. Content or conduct facilitating terrorism or serious violence. 6.3. Deliberate intrusion, hacking, or attacks against the Service or other Tenants. 6.4. Distribution of malware.


7. Reporting and enforcement

7.1. Report suspected abuse or violations to duncan.dimech@exorgroup.com. 7.2. EXOR may investigate suspected violations and may remove or disable content, suspend or restrict access, or terminate accounts in accordance with the Terms. 7.3. Where practicable and where the matter is not serious, EXOR will give notice and an opportunity to remedy before terminating; serious or deliberate violations may be actioned immediately. 7.4. EXOR may preserve and disclose information where required by law or to respond to lawful requests, including forwarding Tenant details to authorities on a lawful request (see Terms clause 14.4).


8. Changes

EXOR may update this AUP to address new or emerging misuse or legal requirements. The current version is always available at /legal/acceptable-use. Continued use after an update constitutes acceptance.


This AUP supplements and does not limit the Terms and Conditions, Privacy Policy, and Data Processing Agreement.
